Judge halts warrantless immigration arrests in Oregon after calling tactics violent and brutal
February 5, 2026

A US federal judge in Oregon has ruled that immigration agents are forbidden from arresting people without a warrant unless there is a clear risk the person might escape. Judge Mustafa Kasubhai issued this preliminary injunction, a temporary court order, as part of a class-action lawsuit against the Department of Homeland Security.
In his ruling, the judge described the agents' tactics as "violent and brutal." He also raised serious concerns that people were being denied their right to due process, the fair legal treatment guaranteed by the Constitution, during immigration raids. The lawsuit was filed by the non-profit group Innovation Law Lab. This court order will stay in place as the legal case continues.
