Far-right extremist Jacob Hersant has been sentenced to one month in jail after losing his appeal against a conviction for performing a Nazi salute. Victorian County Court Judge Simon Moglia handed down the new sentence, ruling that Hersant intentionally used the gesture on October 27, 2023. The judge found the act contemptuous, noting that it showed a blatant disregard for the law and violated a community correction order (a type of supervised probation) that Hersant had just received for his role in a violent brawl.

During the proceedings, the court viewed video footage showing Hersant standing next to fellow neo-Nazi Thomas Sewell. In the clip, Hersant raises his arm and says, "nearly did it - it's illegal now," before adding, "Australia for the white man, heil Hitler." His lawyer, Tim Smartt, admitted the probation breach but argued that his client should not be jailed. However, prosecutor Daniel Gurvich KC described the act as a calculated and harmful move. Along with the jail term, Hersant was convicted, ordered to pay a $1,000 fine, and immediately taken into custody.
